# Terms of Service for Nubli
Last Updated: 4 October 2026### 1. Introduction
Welcome to Nubli. These Terms of Service ("Terms") govern your access to and use of the Nubli mobile application (iOS and Android) and web application provided by Otklon Studio ("we", "us", "our"). By downloading, accessing, or using Nubli, you agree to be bound by these Terms and our Privacy Policy.### 2. Eligibility
You must be at least 18 years old to use Nubli. By using the app, you represent and warrant that you meet this age requirement.### 3. Account and Security
You must create an account to use Nubli (e.g., via Email, Google, or Apple accounts). You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately if you suspect any unauthorized access to your account.### 4. User Content and Ownership
You retain 100% ownership of all tasks, folders, notes, and data you create or import into Nubli ("User Content"). You grant Otklon Studio a limited, worldwide, non-exclusive, royalty-free license to host, store, sync, and display your User Content solely for the technical purpose of operating the app and providing the service to you across your devices.### 5. Our Intellectual Property
Otklon Studio retains all rights, title, and interest in and to the Nubli application, including its source code, design system (Material 3, Dieter Rams aesthetic principles, Stencil UI), proprietary concepts (ADHD Dynamics cubic formula, Liquid Timer), and the Nubli brand name and logos.The app utilizes certain third-party libraries—specifically, the "MegaMapa" feature is built upon the Syncfusion Treemap widget, which remains subject to Syncfusion's intellectual property rights and licensing. You may not reverse engineer, decompile, or create derivative works from the Nubli application.### 6. Subscriptions, Free Trial, and Billing
Nubli is a premium productivity tool. Full access to all app features requires an active subscription (monthly or annual).
* Free Trial: We offer a 14-day free trial for new users. If you do not cancel before the 14-day trial ends, you will be automatically billed for the selected subscription period.
* Billing and Auto-Renewal: All subscriptions and financial transactions are processed securely through the Apple App Store or Google Play Store. Subscriptions automatically renew unless you cancel them at least 24 hours before the end of the current billing period.
* Cancellations and Refunds: You must manage cancellations directly through your Apple ID or Google Play account settings. Because all transactions are handled by Apple and Google, Otklon Studio cannot process refunds directly. Refund eligibility is strictly subject to the Apple Media Services Terms and Google Play Terms of Service.
* Future Plans: We reserve the right to introduce different pricing tiers in the future (e.g., a freemium tier with a fixed task limit, or a Pro tier for teams).### 7. AI Features and Automation
Nubli utilizes third-party AI services (Google Gemini API) to enhance your workflow.
* Functionality: AI is currently used for the one-time translation of pre-installed demo tasks and for the automatic parsing of text imported via your device's clipboard or share sheet.
* User Verification: Tasks generated via the AI smart import are created automatically without a preview step. It is your responsibility to review, edit, and verify the accuracy of the generated task names and contexts after they appear in your inbox. The description of the task will preserve the exact content you originally provided.
* No Model Training: Your data is processed using a commercial API tier and is not used to train Google's AI models.
* "As Is" Clause: AI-generated content is provided "as is." We do not guarantee its grammatical, factual, or contextual accuracy.### 8. Medical and "No Emergency" Disclaimer
Not a Medical Device: Nubli features a user interface and user experience (UI/UX) designed to be ADHD-friendly and to help overcome task paralysis. However, Nubli is strictly a productivity tool and organizational aid. It is not a medical device. We do not provide medical advice, diagnosis, treatment, or therapy for Attention Deficit Hyperactivity Disorder (ADHD) or any other health condition. You should never use Nubli as a substitute for professional medical care or psychiatric treatment.No Emergency Reliance: Nubli provides local push notifications for task deadlines and daily routines. We do not guarantee the timely delivery of notifications, as this relies entirely on your device's operating system (which may delay or block notifications due to battery saver modes, focus modes, or lack of network). You must not rely on Nubli for medical reminders (e.g., taking medication), emergency alerts, or any situations where a failure could lead to personal injury or severe harm.### 9. Acceptable Use
You agree not to use Nubli to store illegal, offensive, or malicious content. You also agree not to interfere with our servers and databases (e.g., attempting unauthorized access to the Firestore database or sending mass automated requests bypassing the app interface).### 10. Capacity Limits, Recycle Bin, and Termination
* Fair-Use Capacity Limit: To guarantee real-time synchronization, fluid map rendering, and high database responsiveness for all users, accounts are subject to a fair-use capacity limit of up to 1,000 tasks (including active and binned tasks). We reserve the right to adjust capacity limits as our technical infrastructure expands.
* Recycle Bin & Deletion: Deleted tasks are moved to a Recycle Bin (soft delete) and continue to count toward the account capacity limit until they are permanently removed. If you reach the 1,000-task threshold, you must permanently empty items from your Recycle Bin before creating new tasks.
* Account Deletion: You can permanently and irreversibly delete your account and all associated data at any time directly from within the app settings.
* Termination: We reserve the right to suspend or terminate your account immediately, without prior notice, if you violate these Terms.### 11. Limitation of Liability and "AS IS" Warranty
Nubli is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, Otklon Studio disclaims all warranties, express or implied. Otklon Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities (e.g., missed deadlines).
In no event shall our total liability to you for all claims arising out of or relating to your use of the app exceed the amount you paid to us in the twelve (12) months preceding the claim.### 12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of France. If you are a consumer residing within the European Union, you also benefit from any mandatory provisions of the consumer protection laws of your country of residence.
